A court has announced today acquittal of (8) demonstrators in case of assassination of the Intelligence corporal, Mirghani Al-Gaili who was assassinated during the 18 March 2021 procession after the information under the article (141) (1) of the criminal code was dropped for non-existence of evidence against the accused and that the demonstrators were released.
This came during session of the court today which was chaired by the Hon. Judge Mamoun Jamal Salih Sabdarat , Judge of the public court, who cited the information against the accused and said that this suit was marred by many procedural mistakes in arrest , detention and torture particularly that one of the prosecution witness had come to the court and stated that he was arrested and forced to give this testimony, adding that he appeared before the court from a week-long detention at the military intelligence and that he has nothing to do with the incident.
The judge further added that a testimony of another prosecution witness was untrusted , because he was the deceased’s workmate and he did not see the person who had beaten the deceased and as, the judge explained, there was no evidence tantamount to level of prosecution it was decided cancelling of the information against the 8 demonstrators ,Khalid Mamoun Khidir, Hamza Salih Mahjoub, ShrafF-Eddin Abul-Majid, Suwar Al-Dahab Abul-Azayem, Hussam Mansour Hassan, Michel Games Jal, Musaab Ahmed Mohamed Khairi and Gasim Hasseb.
Meanwhile, Lawyer of the 7th accused , Jaafer Kajo said in a statement to SUNA that the prosecution committee is in the process to level information against all those contributed and incited the witness Jad Karim to give a false and fabricating testimony and against all those ciontributed in conducting the investigation to obstruct justice
